At Adoria Symmetry we take security very seriously, both for the user companies and for the whistleblower. We are prepared to provide the necessary legal certainty to our clients, complying with all relevant national and international regulations for anyone who uses our complaints channel.
Likewise, our platform, as well as the servers in which all the activity that takes place in it is hosted, guarantee its users the best computer security for the data that is registered there.
Legal
The complaints channel has been created following the legal requirements established in Law 2/2023, of February 20, regulating the protection of people who report on regulatory violations and the fight against corruption and DIRECTIVE (EU) 2019/ 1937 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of October 23, 2019, guaranteeing, in any case, the confidentiality of communications and, where appropriate, the anonymity of the informant.
Likewise, the whistleblowing channel offers adequate guarantees in terms of personal data protection, does not contain trackers or monitoring technologies in order to adequately guarantee the anonymity, where appropriate, of the informant and the measures have been implemented. technical and organizational security measures appropriate to the risk after having also carried out an impact assessment on the rights and freedoms of the interested parties. In addition, the corresponding notices are included to comply with the deadlines for notifications and investigation of the communications received.
The sanctioning regime established according to Law 2/2023, of February 20, regulating the protection of people who report on regulatory violations and the fight against corruption, establishes the following sanctions according to the conditions that appear below.
For natural persons:
Light sanctions – €1,001 to €10,000
Serious sanctions – €10,001 up to €30,000
Very serious sanctions – €30,001 up to €300,000
For legal persons:
Light sanctions – up to €100,000
Serious sanctions – €100,001 up to €600,000
Very serious sanctions – €600,001 up to €1,000,000
Computing
The Adoria Symmetry whistleblowing channel is specially designed to protect the data of its users, managers and the companies that use it.
For this, we have a robust, personalized and unique encryption system for each user company, which protects the data registered by the organization and its workers. Not even we have access to the information stored by our clients, who would have to grant us the pertinent permissions to be able to view them.
Furthermore, the recorded data is end-to-end encrypted. In the unlikely event of unwanted access to the complaints channel, the offender would only have unintelligible information and, therefore, no value.
All the information collected in the whistleblowing channel will be stored on our servers in Europe, where the data remains encrypted both in transit and at rest.
Access to the platform will also be protected. The Adoria Symmetry whistleblowing channel has two-factor authentication to guarantee the correct identification of the data manager.
